You are reading the Terms and Conditions of BlueBarn, meaning the contract between you and BlueBarn when you use the BlueBarn site, services and products. Members Sharing Content

Members are encouraged to write articles on BlueBarn.  (How you can contribute articles on BlueBarn is explained elsewhere on the site.) However, please ensure that you write original content.  In case you are taking content from some other source, please acknowledge the source clearly.  Please do not post content that requires prior permission of the owner of the content.

BlueBarn does not endorse, support or guarantee the completeness, truthfulness, accuracy, or reliability of any content posted via its site. You understand and agree that by using the Services, you may be exposed to content that might be inaccurate or incorrect. Under no circumstances will BlueBarn be liable in any way for any content posted by its users.

BlueBarn reserves the right to filter any content posted by its users and remove objectionable posts without notice. BlueBarn reserves the right to edit and make changes to posts, articles and polls submitted by its members and users without notifying them.  If any member of user has any objections to the editing or the changes made, he/she could request for withdrawal of his/her post/article by sending us a mail at thesimplepoint@gmail.com.

As a user of BlueBarn, a member or user is solely responsible for his/her submissions. By transmitting your submissions to the website or otherwise through or by using BlueBarn the member represents that he/she has all rights and authorizations necessary to post, submit, display, produce, or otherwise transmit such content (text, software, data, images, graphics, photos, audio, audio-visual, videos, and content of any nature).

You agree that you will not submit material that is or contains the intellectual property of a third party that you do not have permission to use.

A user shall retain all of his/her ownership rights in his/her  submissions; however, by submitting material to BlueBarn, the user grants BlueBarn full transferable rights to use, reproduce, distribute, modify, transmit, prepare derivative works of, display and produce the material in connection with BlueBarn and its business. To the extent a user does not have ownership rights to any of his/her submissions, he/she shall indemnify BlueBarn for any claims regarding BlueBarn’s use of his/her submissions.

We do not guarantee any confidentiality with respect to any user submissions and will not treat any user submissions as confidential.

Allowable Content and Use

We want to keep BlueBarn a safe, friendly place and that means a few rules.

1. You will not post unauthorized commercial communications (such as spam). You will not collect users’ content or information, using automated means (such as harvesting bots, robots, spiders, or scrapers).
2. You will not engage in unlawful multi-level marketing, such as a pyramid scheme.
3. You will not upload viruses or other malicious code.
4. You will not solicit login information or access an account belonging to someone else.
5. You will not post content that is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence. The removal of such material is strictly BlueBarn’s prerogative.
6. You will not develop or operate a third-party application containing alcohol-related, dating or other mature content (including advertisements).
7. You will not use BlueBarn to do anything unlawful, misleading, malicious, or discriminatory.
8. You will not facilitate or encourage any violations of this Statement or our policies.
9. You will not forge headers or otherwise impersonate someone.
10. You will not post content you do not have the right to transmit
11. You will not post content that infringes on trademarks or copyrights.

Registration and Account Security

BlueBarn users should provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

1. You will not provide any false personal information.
2. You will not create more than one personal account.
3. You will not create an account for someone else. (Without permission).
4. If we disable your account, you will not create another one without our permission.
5. You will keep your contact information accurate and up-to-date.
6. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
7. If you select a username or similar identifier for your account, we reserve the right to remove or reclaim it if we believe it is appropriate.

BlueBarn reserves the right to ban sites and users that do not comply with our Terms and Conditions. Users may not be notified when this occurs.

To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or making corrections. The main form of identity management is your e-mail address. Please always use a valid and up-to-date e-mail address.

Disclaimer

While we have the right to monitor activity and content associated with BlueBarn, we are not obligated to do so. We do not guarantee the accuracy, integrity or quality of any content on BlueBarn because community standards vary and individuals sometimes choose not to comply with our policies and practices. In the process of using BlueBarn, you may be exposed to content that you find offensive or objectionable. We may investigate the complaints and violations of our policies that come to our attention and may take any action that we believe is appropriate,

Under no circumstances will we be liable in any way for any content, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any content on the Website.

By accepting these Terms and Conditions, you agree to indemnify and otherwise hold harmless BlueBarn, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from (1) your use of BlueBarn; (2) unauthorized access to or alteration of your communications with or through BlueBarn, or (3) any other matter relating to BlueBarn. Any business transactions which may arise between users from their use of BlueBarn are the sole responsibility of the users involved, and we disclaim any and all responsibility for such transactions.

Originality of Content

The content posted by BlueBarn would be original in nature although some points and aspects could have been borrowed from other sources. If content, photographs etc. have been borrowed from any source, BlueBarn would, as far as it knows, acknowledge the source. If it comes to light that content of any kind on BlueBarn has been taken without permission or without acknowledging the original source, BlueBarn would not be held liable in any way. It would, however, immediately remove such content from its website.

IT IS EXPRESSLY UNDERSTOOD THAT WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL OUR TOTAL CUMULATIVE LIABILITY EXCEED RS. 100,000.
